Gold Coast construction company, Marc-Worx Pty Ltd, has been ordered by the Federal Circuit and Family Court to pay a $25,000 penalty for failing to comply with Compliance Notices. Â
A Compliance Notice is a legal notice from the Fair Work Ombudsman to an employer who has broken workplace laws. The notice orders the employer to fix the problem and follow the law. Â
Marc-Worx Pty Ltd, failed to back-pay entitlements to two construction workers, and the court has ordered it to back-pay the worker’s outstanding entitlements in full, plus interest.  The Fair Works Ombudsman, Sandra Parker, stated that employers who fail to act on Compliance Notices can face court-imposed penalties on top of having to back-pay workers.Â
The Australian Building and Construction Commission issued the Compliance Notices in March and August 2022, after an investigation in the underpayment of wages and entitlements under the Building and Construction General Onsite Award 2020 and the National Employment Standards. Â
